Officials will be considered for dismissal if they fall into one of the six cases specified in Regulation 41-QD/TW issued by the Politburo on November 3, 2021.
What is staff dismissal?
The Politburo has just issued Regulation 41-QD/TW on the dismissal and resignation of cadres.
Clause 2, Article 2 of Regulation 41-QD/TW explains that the word dismissal means that the competent authority decides to let an cadre stop holding a position before the end of the term or the appointment term has not expired due to failure to meet the requirements. job requirements, reduced reputation, violations but not to the extent of being disciplined for dismissal.
In Article 4 of the Law on Cadres and Civil servants, the concept of cadres is stated as follows:
Cadres are Vietnamese citizens, elected, approved and appointed to hold positions and titles according to term in agencies of the Communist Party of Vietnam, the State, and central socio-political organizations, in provinces and centrally run cities (hereinafter referred to as provincial level), in districts, urban districts, towns and provincial cities (hereinafter referred to as district level), in payroll and receive salary from the bank state books".

Accordingly, Regulation 41 stipulates principles, competence, grounds and procedures for considering the dismissal and resignation of leading and managerial cadres; applied to leaders and managers in the political system (collectively referred to as cadres).
6 cases of officials being considered for dismissal
Accordingly, the consideration of dismissal of an officer is based on one of the following cases:
Firstly, cadres who are disciplined with warnings or reprimands, but whose reputation has deteriorated, cannot hold their assigned positions.
Second, cadres are disciplined and reprimanded twice or more in the same term or within the appointment period.
Third, officials with more than two-thirds of the votes of low confidence at the polling period as prescribed.
Fourth, cadres have 2 consecutive years of being classified as having failed to complete their tasks.
Fifth, cadres were concluded by competent authorities to be degraded in terms of political ideology, morality, lifestyle, "self-evolution", "self-transformation"; violate what party members are not allowed to do; violate the responsibility to set an example, adversely affect the reputation of themselves and the agency or unit where they are working.
Six, cadres were concluded by competent authorities to violate political standards according to regulations on protecting internal politics of the Party to the extent that they had to be dismissed.
Regulation 41-QD/TW takes effect from November 3, 2021 and replaces Regulation 260-QD/TW dated October 2, 2009. 6 in case officials are considered for dismissal according to the latest regulations
