Ms. Nguyen Thi Thanh Tuyen (Dong Thap) asked, in case at the time of paying the bonus, the cadres, civil servants, public employees and employees are no longer working, not on the salary list at the unit (retired, quit, transferred) but during the previous working period were evaluated and classified by the competent authority as having completed the task or above, are they entitled to receive the bonus?

Regarding this issue, the Ministry of Home Affairs responded as follows:

The subjects applying the bonus regime are specifically stipulated in Clause 2, Article 2 of Decree No. 73/2024/ND-CP dated June 30, 2024 of the Government stipulating the basic salary and bonus regime for cadres, civil servants, public employees and armed forces.

The bonus regime is specifically regulated in Article 4 of Decree No. 73/2024/ND-CP, which stipulates that the head of the competent authority or the authority delegated to manage cadres, civil servants and the head of the public service unit is responsible for developing specific regulations to implement the bonus regime applicable to the subjects on the salary list of the agency or unit.
