Through receiving and responding system to proposals of businesses, BIDV Insurance Corporation would like to request the competent authorities to answer some contents related to the addition of bid documents when participating in online bidding.
BIDV Insurance Corporation participated in the property fire insurance package through the National Electronic Bidding System with the lowest bid price.
After submitting the application, the enterprise found that the bidding dossier (HSDT) was lacking of experience documents for dealing with 2 cases of compensation for losses (up to the time of bidding), fixed reinsurance contracts with companies. reinsurance; ranking of reinsurance companies. These documents are in the technical proposal prescribed in the bidding documents.
On June 11, 2018, the company sent additional documents to the procuring entity. The additional documents all meet the provisions of the bidding documents.
Through the receiving and responding system to recommendations of businesses, BIDV Insurance Corporation would like to ask, is the sending additional documents as mentioned above correct and does the bid solicitor have the right to refuse receiving additional documents of the business?
Regarding this issue, The Ministry of Planning and Investment responds as follows:
Clause 1, Article 15 of Decree No. 63/2014 / ND-CP stipulates, the evaluation of the bid packages must follow the standards of the bid evaluation, different requirements specified in the bidding documents, the bid envelopes, demonstration or explanation of the bid envelopes to select the right contractors who prove their proper competence, experience and feasible solutions to executing contracts.
According to Section 22.1 and Section 22.2, Chapter I, Form E-HSMT of non-advisory services promulgated together with Circular No. 04/2017 / TT-BKHDT, After opening bids, contractors are responsible for clarifying E-HSDT at the bid solicitor's request. Accordingly, when required, the contractor submits documents proving the eligibility, capacity and experience to the bid solicitor for the purpose of clarifying E-HSDT of the bid solicitor.
Regarding the technical and financial proposals mentioned in the E-HSDT of the contractor, the clarification must ensure that the principle does not change the basic contents of the submitted E-HSDT and the bid price.
During the evaluation process, E-HSDT clarification between the contractor and the bid solicitor is done directly on the System.
In the case of BIDV Insurance Corporation, for online bidding, the clarification of E-HSDT must comply with the above provisions.
