The Ministry of Construction responded to this issue as follows:

The classification of construction investment projects is implemented according to the provisions of Article 49 of the 2014 Construction Law, amended and supplemented according to the provisions of Clause 8, Article 1 of Law No. 62/2020/QH14.

Accordingly, except for cases where the investment decision maker requests the preparation of a construction investment feasibility study report, construction investment projects only need to request the preparation of a construction investment economic-technical report according to the provisions of Clause 3, Article 5 of Decree No. 15/2021/ND-CP dated March 3, 2021 of the Government detailing a number of contents on the management of construction investment projects.

Construction investment consultancy costs are implemented in accordance with Article 31 of Decree No. 10/2021/ND-CP dated February 9, 2021 of the Government on management of construction investment costs, Appendix VIII of Circular No. 12/2021/TT-BXD dated August 31, 2021 of the Minister of Construction on promulgating construction norms.

In case of applying inappropriate consultancy cost norms, the consultancy costs are determined by making an estimate based on the scope of consultancy work, the volume of work to be performed, the implementation plan and regulations on regimes and policies issued by the State.

The consultancy cost estimate is guided in Appendix VI of Circular No. 11/2021/TT-BXD dated August 31, 2021 of the Minister of Construction guiding a number of contents on determining and managing construction investment costs.
