Since the rice to be purchased is domestically produced, all participating contractors are entitled to the same benefits.

Mr. Quyen asked whether in the E-Bidding Documents, his unit does not apply the incentives as stipulated in Article 5 of Decree No. 63/2014/ND-CP, is this in accordance with the regulations or not?

Regarding this issue, the Ministry of Planning and Investment replied as follows:

For procurement packages that have issued invitation documents before January 1, 2024, the selection of contractors shall be conducted in accordance with the provisions of the Bidding Law No. 43/2013/QH13 and Decree No. 63/2014/ND-CP of the Government.

Article 14, Clause 1 of the 2013 Bidding Law stipulates that contractors are entitled to incentives when participating in domestic bidding or international bidding to supply goods with production costs in the country accounting for 25% or more. For procurement packages of goods, incentives for domestic goods shall be implemented according to the provisions of Article 5 of Decree No. 63/2014/ND-CP of the Government.

According to the guidance in Section 28 - Section I of the Bidding Document Form for procurement packages of goods applying the one-stage, one-envelope method, if the goods offered by contractors are not eligible for incentives, then no evaluation and determination of the incentive value shall be conducted.

Regarding Mr. Quyen's inquiry, in the case where the procurement package is for domestically produced rice and all contractors supplying rice for the package are equally entitled to incentives, the investor, the inviting party, decides not to calculate incentives because calculating incentives would no longer be meaningful.
