(Chinhphu.vn) - Through the receiving and responding system to recommendations of businesses, Mr. Phan Cong Tam, working at the Central Region Rural Power Project Management Unit would like to request the competent authority to answer the organizational model and regulations to re-establish project management unit (PMU) to invest in specialized and regional construction.
The Power Project Management Unit of the Central Region Rural is assigned to manage and execute projects on building, renovating and upgrading rural, mountainous and island electricity distribution networks in the Central region with loans from the World Bank ( WB), the Asian Development Bank (ADB), the German Reconstruction Bank (KfW), the State budget capital; transmission lines and transformer stations up to 110kV voltage level, telecommunication and information technology works, SCADA-EMS system, small and medium power projects and civil construction works ... that the Corporation Central electricity is the investor. Investment scale of managed projects ranges from VND 50 billion to VND 1,000 billion.
According to Clause 2, Article 5 of the Circular 16/2016 / TT-BXD dated June 30, 2016 of the Ministry of Construction guiding the implementation of a number of articles of the Decree 59/2015 / ND-CP dated June 18, 2015 of the Government cover it: “PMBs of multiple projects that are established by investment decision-makers and operating in regulatory authorities, economic groups or State-owned corporations shall be re-organized to satisfy field-based or area-based PMB criteria under the Law on Construction. ”.
At Point a, Clause 3, Article 20 of the Circular 16/2016 / TT-BXD also stipulates: “…Field-based and area-based PMBs must be re-organized by October 31, 2016;”.
Mr. Phan Cong Tam would like to ask, based on the above regulations, is his unit subject to compulsory re-establishment procedures? If it has to be re-established, who is the deciderfor setting up? and how is procedure for implementation?
The Ministry of Construction answered this issue as follows:
As stipulated in Clause 1, Article 63 of the Construction Law, “Ministers, heads of ministerial-level agencies, chairpersons of provincial- level People’s Committees, chairpersons of district-level People’s Committees or competent representatives of state enterprises shall decide on the establishment of specialized construction investment project management units or regional construction investment project management units to manage a number of projects of the same sector or in the same line or the same area”.
According to the contents asked, the Central Rural Power Project Management Unit is directly under the Central Power Corporation established by the Vietnam Electricity Corporation.
With the above-mentioned contents, the Central Rural Power Project Management Unit does not have to carry out procedures to re-establish the Unit.
Based on specific conditions and scope of work of the Board to propose the competent person to supplement, consolidate the organization and operation of the Unit in accordance with the Circular No. 16/2016 / TT-BXD dated June 30, 2016 of the Ministry of Construction in case of failure to meet the requirements.
The supplementation, consolidation of the organization and operation of the Board (if any) shall be decided by the authorized representative of the Corporation.
