Mr. Nguyen Quy (in Phu Tho Province) is assigned a task of an investor with a bidding package using state budget capital. His department was assigned to perform the task. After implementing the bidding process, his agency collects a sum of money from the sale of the bidding documents.
Mr. Quy would like to ask, can his agency use this proceeds to pay for expenses such as publishing bidding reports, paying price appraisal fees? How is the implementation process correct?
Mr. Quy is expected to advise the implementation as follows: The leader of the agency considering the request of the specialized division shall make a decision to spend money from purchasing bidding documents to pay the bidding costs (expenses for publication and appraisal of prices). . After having decided to spend, he was sent to transfer money to the account of the valuation unit. So is this correct? If wrong, what should he do?
Regarding this issue, The Ministry of Finance has the following opinions:
Because Mr. Quy did not provide details about the source of capital for the procurement which is the finance resource: State Finance for procurement in order to maintain the regular operation of state agencies, units of the people's armed forces, units of public non-business organizations, political organizations, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations or state finance sources and bond funds of Government for implementing investment projects. Therefore, the Ministry of Finance does not have enough information to answer him.
However, regarding the content of his questioning we recommend him to study the following Circulars and the nature of the bidding package to be assigned (finance resource and content of the bidding package) to comply with regulations, specifically:
- Circular No. 190/2015 / TT-BTC dated November 17, 2015 of the Ministry of Finance regulating the management and use of costs in the process of selecting contractors for projects using state capital and Government bond finance;
