Point c, Clause 7, Article 4 of Law No. 57/2024/QH15 amends and supplements the first paragraph of Point m, Clause 1, Article 23 of the Law on Bidding on bid designation: "A bid package under a non-project procurement estimate has a bid package price not exceeding VND 300 million; a bid package under a project has a bid package price not exceeding VND 500 million for a consulting service bid package, not exceeding VND 1 billion for a non-consulting service, goods, construction and installation, and mixed bid package; a bid package for planning tasks has a bid package price not exceeding VND 500 million".

However, Mr. Tran Quoc Khanh (Dong Thap) did not see the bid designation limit for the bid package under the project procurement estimate. He requested that the competent authority provide guidance on how to determine the value of the bid designation limit for this bid package.

Regarding this issue, the Ministry of Finance has the following comments:

According to the provisions of Point m, Clause 1, Article 23 of the Law on Bidding (amended at Point c, Clause 7, Article 4 of Law No. 57/2024/QH15), the bidding package under the procurement estimate that does not form a project has a bidding package price not exceeding VND 300 million; the bidding package under the project has a bidding package price not exceeding VND 500 million for the bidding package of consulting services, not exceeding VND 1 billion for the bidding package of non-consulting services, goods, construction and installation, mixed services; the bidding package for planning tasks has a bidding package price not exceeding VND 500 million and is subject to the form of designated bidding.

Based on the above provisions, in case the bidding package belongs to a project (using regular expenditure capital from the state budget) with a bidding package price not exceeding VND 500 million for consulting service bidding packages, not exceeding VND 1 billion for non-consulting service, goods, construction and installation, and mixed bidding packages, the form of designated bidding shall be applied.
