Mr. Chung has been in charge of the unit for over 30 months (2 and a half years), but the higher authorities have not shown any intention to replace or appoint him to the director level.

Mr. Chung inquired whether there is a regulation regarding the tenure of the deputy director in charge.

Regarding this matter, the Ministry of Home Affairs responded as follows:

According to the regulations in Article 37 of the Law on Civil Servants of 2010 and Articles 44, 45, and 46 of Decree No. 115/2020/ND-CP, the appointment of managerial civil servants must be based on the needs of the public sector unit, the standards, and the requirements of the managerial position, and must follow the appropriate authority, procedures, and formalities.

The authority to appoint civil servants to hold managerial positions lies with the head of the public sector unit or is proposed by the competent level according to the management hierarchy.

Therefore, the appointment of Mr. Chung to hold the managerial position is within the authority of the head of the public sector unit or is subject to the proposal by the competent level according to the management hierarchy.

It is recommended that Mr. Chung contact the relevant provincial authorities for guidance and clarification according to their authority.
