Mr. Hieu referred to Clause 2, Article 76 of Decree No. 15/2021/ND-CP and Form No. 01, Appendix IV of this Decree, it is not required to declare the process of professional activities in construction for cases where Mr. Hieu (request for re-issuance of certificate because the old certificate has expired).

Thus, it also means that for a certificate re-issued due to its expiration, there is no need to prove the experience (because the first-time experience has been proven).

Mr. Hieu requested the Ministry of Construction to consider and guide him to complete the application for eligibility for a practicing certificate as prescribed.

Construction Management Department, Ministry of Construction responded to this issue as follows:

To carry out the procedures for renewing the construction practice certificate, he needs to complete a set of documents as prescribed in Clause 1, Article 76 of Decree No. 15/2021/ND-CP dated March 3, 2021 of the Government. The Government shall detail a number of contents on management of construction investment projects, including an application form for a construction practice certificate, made according to Form No. 01, Appendix IV.

Note, in the notes section of Form No. 01, Appendix IV has a point that no declaration of experience is required in case of requesting for re-issuance of the certificate because the old certificate is expired/torn or broken/lost.

However, he needs to make a declaration of experience, provide decisions on assignment of tasks corresponding to the declaration of experience (stipulated in Point dd, Clause 1, Article 76 of Decree No. 15/2021/ND- CP) and submit it to the One-stop Department – Office of the Ministry of Construction for consideration and settlement.
