Clause 4, Article 8 of Decree 100/2019/ND-CP stipulating penalties for administrative violations in the field of road and railway traffic (added by Clause 6, Article 2 of Decree 123/2021/ND-CP). amending and supplementing a number of articles of the Decrees on sanctioning of administrative violations in the field of maritime, road traffic, railway, civil aviation) regulations on penalties for drivers of bicycles and vehicles motorcyclists (including electric bicycles), other rudimentary vehicle operators violate the following road traffic rules:
4. A fine of between VND 400,000 and VND 600,000 shall be imposed on vehicle operators who commit one of the following violations:
a) Operating a vehicle on an expressway, except for vehicles serving the management and maintenance of the expressway;
b) Causing a traffic accident without stopping, failing to maintain the scene, fleeing without reporting to the competent authority, failing to participate in first aid for the victim;
c) Driving on the road with an alcohol concentration exceeding 80 milligrams per 100 milliliters of blood in the blood or breath or 0.4 milligrams per 1 liter of breathing air;
d) Failure to comply with the request of the official to test the alcohol concentration.
đ) The operator of a motorbike (including an e-bike) does not wear a “helmet for motorcyclists and motorbike riders” or wears a “helmet for motorcyclists” and does not fasten the straps properly when in traffic;
e) Carrying occupants on motorbikes (including electric bicycles) without wearing “helmets for motorcyclists” or “helmets for motorcyclists” without proper straps specifications, except for transporting patients to the emergency room, children under 06 years of age, escorting people with illegal acts.
Thus, e-bike drivers without helmets can be fined from VND 400,000 to VND 600,000.
