(Chinhphu.vn) – According to Mr. Ngo Dat Tri, currently, small companies are developing websites to display products, without prices, shopping carts, ordering features, online trading features, but assigned a name as the e-commerce website and the inspector are obliged to notify and register with the Ministry of Industry and Trade, otherwise a fine will be imposed.
Mr. Tri affirms that this is a barrier and causes difficult for companies in the development phase. Through the receiving and responding system to people's feedback and recommendations, Mr. Tri would like to requestfor consideration, the concept of e-commerce website (general e-commerce) assigned to all basic product websites will go against with definitions in the world.
Regarding this issue, Ministry of Industry and Trade responds as follows:
Under the provisions of Clause 1, Article 25 of the Decree No. 52/2013 / ND-CP dated May 16, 2013 of the Government on e-commerce,: “The sales e-commerce website is an e-commerce website developed by the traders, organizations or individuals by themselves to serve their commercial promotion, sales or service supply”
”Article 27 of this Decree stipulates that, when operating an e-commerce website, enterprises should carry out procedures to notify the Ministry of Industry and Trade.
Clause 10 Article 3 of the Commercial Law provides: “Commercial promotion means activities of promoting and seeking opportunities for the purchase or sale of goods and provision of services, including sale promotion, commercial advertisement, display and exhibition of goods and services, and trade fairs and exhibitions”.
E-commerce is just one of the methods of conducting commercial activities. Traders, organizations and individuals when building websites to introduce products and services, including not having the function of online ordering, shopping cart, payment ... are still conducting trade promotion activities. Part of commercial activity is for the sake of profit.
In the context of growing business and trade based on technology applications, the website is a very effective means of providing information, leading consumers to access goods and services. However, the website is also a vehicle with high flexibility, easy to remove traces, information structure and features of the website can be easily changed.
Therefore, the requirement of the Decree No. 52/2013 / ND-CP on the notification obligations of owners of e-commerce website is a universal requirement, applicable to all types of websites for trade operation., from websites displaying and introducing goods and services to websites that feature online ordering, regardless of whether the website's structure is simple or complex.
Under the provisions of Clause 1, Article 25 of the Decree No. 52/2013 / ND-CP dated May 16, 2013 of the Government on e-commerce, the owner of the e-commerce website must notify the state management agency.
The "Notice of e-commerce website" procedure is implemented online at level 4 (the highest level of online public service) at the Ministry of Industry and Trade's E-Commerce Management Portal - www.online.gov. VN. When conducting a notice, the enterprise only needs to provide the website address, website type, business / operation area, office address and some other basic information of the website owner.
