When Mr. Hieu went to the Ward People's Committee to work, he was informed that there was no document guiding the confirmation of income proof in cases like his. According to the information Mr. Hieu knew, the Ward People's Committee only needed to authenticate his declaration.
Mr. Hieu asked, does the People's Committee certify the declaration in two forms of income identification and subject confirmation, does it satisfy the conditions for approval by the Department of Construction? What should he do to comply with the regulations?
The Ministry of Construction responded to this issue as follows:
Clause 2, Article 30 of Decree No. 100/2024/ND-CP stipulates: "In case the subject specified in Clause 5, Article 76 of the Housing Law does not have a labor contract, if he is single, the actual monthly income received shall not exceed 15 million VND, if he is married according to the provisions of law, the applicant and his spouse shall have a total actual monthly income received not exceeding 30 million VND. Within 07 days from the date of receipt of the request for confirmation, the People's Committee at the commune level shall confirm the income conditions in 01 consecutive year from the time the subject specified in this clause submits a valid application to the investor to register to buy or rent-purchase social housing".
Circular No. 05/2024/TT-BXD dated July 31, 2024 of the Minister of Construction detailing a number of articles of the Housing Law provides guidance on the identification of subjects and income for subjects specified in Clause 5, Article 76 of the Housing Law 2023 (without a labor contract) as follows:
- Confirmation of subjects confirmed by the People's Committee of the commune where permanent or temporary residence is registered (Form No. 01, Appendix I of Circular No. 05/2024/TT-BXD);
- Documents proving income conditions to be eligible to buy social housing confirmed by the People's Committee of the commune where the person declaring the Declaration of income conditions is a low-income person (Form No. 05, Appendix I issued with Circular No. 05/2024/TT-BXD).
In case the applicant for purchase or lease-purchase of social housing is married, his or her spouse must also declare a form of documents proving income conditions according to Form No. 04 or Form No. 05 in Appendix I of Circular No. 05/2024/TT-BXD (stipulated in Clause 1, Article 8 of Circular No. 05/2024/TT-BXD).
Thus, the law on housing has specific regulations and instructions on confirming the subjects and income conditions for subjects who are low-income people in urban areas (without labor contracts).
At the same time, in the confirmation forms, the declarant must guarantee that the statements he or she has made are true and is fully responsible before the law for the declared contents.
