According to Clause 8, Article 15 of Decree No. 175/2024/ND-CP:
"For projects that only require the preparation of an economic-technical report on construction investment, when approving the project, the investment decision maker shall assign the investor to stamp and approve the design documents of the construction drawing of the economic-technical report on construction investment".
Clause 7, Article 19 stipulates:
"7. Stamping of basic design documents and returning of results are carried out as follows:
a) The specialized construction agency shall stamp the contents that have been appraised on the relevant drawings of 01 set of basic design drawing documents. The sample stamp of appraisal is specified in Form No. 12, Appendix I of this Decree;
b) For appraisal documents that are concluded to be eligible for submission for synthesis and approval, the specialized construction agency shall check and stamp the basic design drawings. The person requesting appraisal shall receive the appraisal results including the Notice of appraisal results and the drawing documents that have been stamped with the appraisal confirmation stamp;".
Mr. Pham Tien Dung (Thanh Hoa) asked, for a one-step project to prepare an economic-technical report, does the appraisal agency need to stamp the design documents?
The Ministry of Construction responded to this issue as follows:
According to the provisions of Point b, Clause 3, Article 56 of the 2014 Law on Construction, as amended and supplemented in Clause 13, Article 1 of the Law on Amendments and Supplements to a Number of Articles of the Law on Construction No. 62/2020/QH14, the project only needs to prepare a construction investment economic-technical report and does not have to undergo appraisal at a specialized construction agency; the person deciding on the investment appraises the contents as prescribed in Clause 3, Article 57 of the 2014 Law on Construction, as amended and supplemented in Clause 14, Article 1 of the Law No. 62/2020/QH14.
The law on construction only stipulates the stamping of drawings that have been appraised by a specialized construction agency (Clause 7, Article 19 and Clause 7, Article 47 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government detailing a number of articles and measures to implement the Law on Construction on the management of construction activities); it does not stipulate the stamping of drawings appraised by a specialized agency of the investment decision maker.
However, according to the provisions of Clause 8, Article 15 of Decree No. 175/2024/ND-CP: "For projects that only require the preparation of a construction investment economic-technical report, when approving the project, the investment decision maker shall assign the investor to stamp the approval of the construction drawing design documents of the construction investment economic-technical report".
Therefore, we suggest that you study the above provisions to comply with the regulations.
