In this regard, the Ministry of Public Security responded as follows:
Pursuant to Article 601 of the 2015 Civil Code, means of transport are sources of extreme danger, so the owners of sources of extreme danger possessing and using sources of extreme danger must compensate for damage caused by the sources of extreme danger. If the owner has assigned it to another person to possess and use, this person must compensate, unless otherwise agreed. The owner, possessor or user of a source of extreme danger must compensate for damage even when there is no fault, unless the damage is caused entirely by the intentional fault of the person suffering the damage or the damage occurs in the force majeure or emergency situations, unless otherwise provided for by law. On a case-by-case basis, vehicle owners and heads of transport business units whose drivers and vehicles cause traffic accidents will be examined for penal liability according to the provisions of Articles 263, 264 of the Penal Code 2015.
