Specifically, the task "Putting soil and sand sacks under water to treat erosion pits, foundation pits and landslides using 200T barge" with the norm code TLB.22511 does not have the norm of waste of soil materials (sand) while the work component has the job of shoveling soil and sand that has been gathered into the sacks (about 70% of the bag volume). Most of the works to deal with shoreline erosion in the Mekong Delta area use technical solutions of rock carpets in the river with common carpet sizes such as: (10x3x0.3) m; (8x3x0.3) m; (5x3x0.3) m; (4x3x0.3) m with the same distance to drop the stone carpet (L) from the bank to the river as: L ≤ 30 m; 30 m < L ≤ 70 m; L > 70 m to stabilize the shoreline. However, there is no norm for this construction work. Therefore, Mr. Duy asked for guidance from the competent authority on the application of the norm code TLK.13400 for the work of making and releasing stone mats in the river.
The Ministry of Agriculture and Rural Development responded to this issue as follows:
Work norm "Piling soil and sand sacks under water to treat erosion holes, foundation pits and landslides using 200T barge", code TLB.2251 issued in Decision No. 2962/BNN-XD dated 6/7 /2021 of the Ministry of Agriculture and Rural Development only determines the waste of materials for sacks to store soil (sand) but does not include the volume of backfill material which is soil (sand) gathered at the embankment.
The determination of soil (sand) volume according to design requirements is in accordance with current standards and regulations.
For the work "Make and drop carpets (gab) of stones in the river" the norms promulgated by the Ministry of Construction shall be applied.
In case the construction work has not been regulated or has been specified in the construction norm system promulgated by a competent state agency but is not consistent with the design, technical requirements, construction conditions, and construction method of the work, the determination of new cost estimates and adjustment of norms to apply to the work shall comply with the provisions of Article 21 of Decree No. 10/2021/ND-CP dated February 9, 2021 of the Government and guidance in Circular No. 13/2021/TT-BXD dated August 31, 2021 of the Ministry of Construction.
The application and reference to the norm system promulgated by the competent authority shall comply with the provisions of Clause 3, Article 136 of the Construction Law, as amended and supplemented in Clause 51, Article 1 of the Law amending and supplementing a number of regulations.
