According to Section 5, Appendix I of Circular No. 08/2021/TT-BXD, in case the regulations on management of urban architecture of the areas have an area smaller than that specified in this Circular, the Regulation fee is determined by the cost of the smallest area in Table 1 above.
So for a city of 200 ha, is the cost 200 ha x norm or 500 ha x norm (minimum area cost) as in Section 5?
The Ministry of Construction responded to this issue as follows:
The cost for making regulations on architecture management is guided in the Circular No. 08/2021/TT-BXD dated August 2, 2021 of the Ministry of Construction guiding the method of determining the cost of making and organizing the construction management regulations.
Appendix I of the Circular stipulates the cost norms for making regulations on management of urban architecture for areas with an area of < 500 ha. Therefore, for the case mentioned in the question, the cost of making an architecture management regulation is determined according to the formula guided in Article 2 of Circular No. 08/2021/TT-BXD:
In case the regulation on management of urban architecture of the areas has an area smaller than the area scale specified in Circular No. 08/2021/TT-BXD, the cost of making the architectural management regulation shall be determined according to the provisions of Point 5, Appendix I of Circular No. 08/2021/TT-BXD.
