E-HSMT stipulates as follows:

"Experience in implementing contracts for the supply of similar goods: The Contractor has completed at least 01 similar contract as a main contractor (independent or member of a joint venture) or subcontractor within the period from January 1, 2021 to the time of bid closing.

In which similar contracts are:

- Of similar nature: Contracts for the supply of chemicals for domestic water treatment, of the same type, similar in characteristics and usage features with the goods: chemical No. 1, chemical No. 2, chemical No. 3, chemical No. 4, chemical No. 5.

The Contractor must attach the following documents to prove (attach scanned originals or notarized copies within the prescribed time limit): Contract; minutes of acceptance or contract liquidation; VAT invoice

- Of minimum scale (value): 12,000,000,000".

The participating contractor is the contractor producing chemical 1, chemical 2 and trading chemical 3, chemical 4, chemical 5. But submitted 2 similar contracts for chemical 1 worth 7 billion VND, chemical 2 worth 6 billion VND, the rest did not mention the contracts for the remaining 3 chemicals.

Ms. Nguyen My Lien (Phu Tho) asked, so does the contractor's E-HSDT meet the requirements on capacity and experience?

Regarding this issue, the Ministry of Finance has the following comments:

According to the provisions of Clause 1, Article 15 of Decree No. 63/2014/ND-CP, the evaluation of bidding documents must be based on the criteria for evaluating bidding documents and other requirements in the bidding documents, based on the submitted bidding documents, documents explaining and clarifying the bidding documents of the bidders to ensure the selection of bidders with sufficient capacity and experience, and feasible solutions to implement the bidding package.

According to the instructions in Table No. 01, Section 2.1, Chapter III, Form E-HSMT for one-stage goods with two dossier envelopes issued with Circular No. 22/2024/TT-BKHĐT, the bidder has completed at least 01 similar contract as a main contractor (independent or member of a joint venture) or subcontractor within the time specified in E-HSMT up to the time of bidding closing.

According to the instructions in note 10 of this table, similar in nature: are goods with the same Chapter code, Group code (corresponding to the first 4 digits of the code set) in the Harmonized Commodity Description and Coding System (HS) according to the Commodity Classification System issued by the World Customs Organization WCO (generally referred to as HS code). HS code is based on Circular No. 65/2017/TT-BTC of the Minister of Finance (posted on the electronic information page: https://www.customs.gov.vn).

In case the investor and the inviting party have difficulty in determining the HS code of the goods, the E-HSMT is provided with similar provisions on type and nature as having the same type, similar in technical characteristics and usage features with the goods of the bidding package under consideration.

In this case, if the bidder determines the HS code of the goods according to the requirements of the bid package and the HS code of the goods in the item, the contract has been performed (accepted) in the same group (corresponding to the first 4 digits of the code set), then this item, contract is considered similar in type and nature for consideration and evaluation. In case the bid package has many items, only the HS code is specified for the main items of the bid package.

Accordingly, the evaluation of E-HSDT (including the content of the nature and scale of similar contracts) is carried out according to E-HSMT on the basis of the above instructions and is the responsibility of the expert team and the bidding party.
