Regarding this issue, the Vietnam Social Insurance replied as follows:
Under Article 102 of the 2014 Social Insurance Law, the process for resolving maternity leave benefits is as follows:
• Within 45 days from the date of returning to work, the employee is responsible for submitting the application to the employer.
• Within 10 days from the date of receiving a complete application from the employee, the employer is responsible for preparing and submitting the application to the Social Insurance agency.
• The responsibility of the Social Insurance agency is to resolve the application and disburse the benefits to the employee within 10 days from the date of receiving a complete application from the employer.
• If the Social Insurance agency cannot resolve the application, they must provide a written explanation and state the reasons.
Additionally, to check the submitted application and processing status, she can access the Vietnam Social Insurance Portal (https://dichvucong.baohiemxahoi.gov.vn). She can go to the function "Search for Application" -> "Processing Status" and enter the application number to check.
Based on the search on the data management system of the Vietnam Social Insurance, as of March 2023, the social insurance code that she provided has not yet been approved for maternity leave. We have received her feedback and transferred it to the Social Insurance of Bac Ninh province where she is participating in social insurance for verification and rechecking.
