Both Mr. Nguyen and his wife work as laborers in factories and are not civil servants or public officials.
Currently, the State is reclaiming land, and the district People's Committee has determined that Mr. Nguyen's family is not a direct agricultural production household because they do not have a regular income from agricultural land. Mr. Nguyen asked if this is correct?
The Ministry of Natural Resources and Environment responded to this issue as follows:
Regarding the question Mr. Nguyen raised, according to the legal regulations on land, the determination of individuals engaged in direct agricultural production is carried out in accordance with the provisions of Article 30 of the Land Law, Article 2 of Decree No. 01/2017/NĐ-CP dated January 6, 2017, issued by the Government amending and supplementing some detailed regulations for the implementation of the Land Law, and Articles 1, 2, and 4 of Circular No. 33/2017/TT-BTNMT dated September 29, 2017, issued by the Ministry of Natural Resources and Environment, providing detailed regulations on Decree No. 01/2017/NĐ-CP, and amending and supplementing some provisions of circulars guiding the implementation of the Land Law.
It is recommended that Mr. Nguyen contact the competent authority in the locality to confirm the household's or individual's status as directly engaged in agricultural production in accordance with the legal provisions.
