Mr. Vu asked whether, according to Decree No. 35/2023/ND-CP, these adjustments must have approval from the competent authority, rather than simply reducing the volume or drafting a technical handling report.

The Ministry of Construction responded as follows:

For project adjustments requiring the preparation of a technical-economic report, follow the regulations in Clause 8, Article 12 of Decree No. 35/2023/ND-CP dated June 20, 2023, amending and supplementing several articles of the decrees under the state management of the Ministry of Construction, effective from June 20, 2023:

"Article 12: Amendments and supplements to several articles of Decree No. 15/2021/ND-CP dated March 3, 2021, of the Government on detailing several aspects of construction investment project management.

… 8. Supplementing Clause 5 of Article 19 as follows:

"5. For project adjustments requiring only a technical-economic report, the decision-maker on investment will review and decide as follows:

a) If the adjustment increases the total construction investment by more than 10% as stipulated in Points b and c of Clause 3, Article 5 of this Decree, a revised feasibility study report must be prepared, and the adjustment appraisal must be conducted per Clauses 2, 3, and 4 of this Article.

If only the total construction investment is adjusted without altering the construction design, a basic design is not required; the construction drawing design in the technical-economic report can be used to prepare the revised feasibility study report and proceed with the next steps.

b) If only the construction drawing design is adjusted without changing the contents stipulated in Clause 2 of this Article and does not fall under the case stipulated in Point a of this Clause, after the investment decision-maker approves the project adjustment, the investor shall appraise and approve the adjusted contents."
