Mr. Ha Xuan Cuong (in HCMC City) participates in the implementation of annual district-level land use planning projects (packages under VND 500 million). The project will have 4 bidding packages according to Circular No. 09/2015 / TT-BTNMT dated March 23, 2015 and Circular No. 04/2006 / TT-BTNMT dated May 22, 2006.

According to the provisions of Clause 2, Article 56 of Decree No. 63/2014 / ND-CP, the bidding packages providing consulting services under VND 500 million, urgent bidding packages need to be implemented to protect national sovereignty will be assigned a shortened contractor.

According to the provisions of Article 16, Article 17 of Circular No. 58/2016 / TT-BTC, the bidding packages for providing consulting services and urgent bidding packages that need to be implemented to protect national sovereignty can only be implemented and follow the normal contractor appointment process.

Mr. Cuong would like to ask, are bidding packages providing consulting services under VND 500 million, urgent bidding packages that need to be implemented to protect national sovereignty are applied in the form of shortened appointment of contractors? As he understands, Circular No. 58/2016 / TT-BTC has more restrictive provisions on bidding packages than Decree No. 63/2014 / ND-CP because bidding packages are done annually, but the procedures follow appointment of contractors normally takes a very long time, until the implementation is completed legal procedures that cannot be completed.

The Ministry of Planning and Investment answers this issue as follows:

For bidding packages of development investment projects, the application of shortened contractor designation shall comply with Clauses 1 and 2, Article 56 of Decree No. 63/2014 / ND-CP.

Accordingly, the urgent bidding package that needs to be implemented with the aim of protecting national sovereignty, borders and islands costing no more than VND 500 million shall comply with the shortened contractor appointment process; In case this package is priced over VND 500 million, it shall comply with the normal contractor appointment process according to Article 55 of Decree No. 63/2014 / ND-CP of the Government.

In addition, for regular procurement bidding packages under the scope of regulation of Circular No. 58/2016 / TT-BTC, the provisions of this Circular shall apply.
