(Chinhphu.vn) - Ms. Nguyen Thi Nhung (in Dak Lak Province) would like to ask: Which cases are understoodwhen going to medical school as mentioned in Item 4, Article 2 of the Decree No. 64/2009 / ND-CP?If employees are sent to learn a master's degree under the decision of the Department of Health, Department of Home Affairs, ishe/she entitled incentive allowance according to the Circular 02/2012 / TTLT-BYT-BNV-BTC?
Regarding this issue, The Ministry of Health responds as follows:
At Point c, Clause 4, Article 2 of the Joint Circular No. 06/2010 / TTLT-BYT-BNV-BTC dated March 22, 2010 of the Ministry of Home Affairs, the Ministry of Finance and the Ministry of Health guide the implementation of the Decree 64 / 2009 / ND-CP dated July 30, 2009 of the Government on policies for health workers and officials working in areas with particularly difficult socio-economic conditions:
"Medical officers, officers and military personnel are not entitled to preferential allowances as stipulated in Clause 1 of this Article during their working or studying in the country and do not directly work as consecutivelymedical professionalsmore than3 months (except for medical professionals) ”.
Cases that are subject to the application of Joint Circular No. 06/2010 / TTLT-BYT-BNV-BTC to study health care are cases decided to be sent to study by the directcompetent management agencies to improve professional skills in the field of disease prevention, examination - treatment, rehabilitation ...
Officials go to improve their professional qualifications in the above-mentioned fields from intermediate to university, from university to master, specialty 1 and specialty 2 are entitled to preferential allowances as prescribed.
In case of not enjoying the preferential treatment for medical care
In Article 3 of the Joint Circular No. 02/2012 / TTLT-BYT-BNV-BTC, stipulating: “The time for studying in the country consecutively more than 3 months that not directly doing medical expertise according to the assigned tasks to public officials and civil servants that are not allowed to enjoy preferential allowances according to medical profession ”.
Thus, the cases are subject to the application of the Joint Circular No. 02/2012 / TTLT-BYT-BNV-BTC have time to study in the country consecutively for more than 3 months, do not directly work as medical professionals. According to the tasks assigned to public servants and employees of competent authorities, they are not entitled to enjoy preferential allowances according to medical profession.
