Ms. Giang also wanted to know, in Circular No. 12/2021/TT-BXD dated August 31, 2021 of the Minister of Construction, does the cost of preparing feasibility study reports and economic-technical reports include the cost of professional liability insurance and author supervision?

The Ministry of Construction responded to this issue as follows:

The application of legal provisions on construction corresponds to the time of implementation of the construction investment project.

Currently, for construction investment projects within the scope of regulation and subject to application of Decree No. 10/2021/ND-CP dated February 9, 2021 of the Government on management of construction investment costs, construction investment consultancy costs are implemented according to Article 31 of Decree No. 10/2021/ND-CP, Appendix VIII of Circular No. 12/2021/TT-BXD dated August 31, 2021 of the Minister of Construction on promulgating construction norms. In which, the content of construction investment consultancy work costs is stipulated in Clause 2, Article 31 of Decree No. 10/2021/ND-CP.

The purchase of insurance by individuals and organizations is guaranteed in accordance with the provisions of the Law on Insurance Business, Decree No. 67/2023/ND-CP dated September 6, 2023 of the Government regulating compulsory civil liability insurance of motor vehicle owners, compulsory fire and explosion insurance, compulsory insurance in construction activities and related guiding documents.

In case of needing more detailed instructions on professional liability insurance, Ms. Giang sent the content to the Ministry of Finance for instructions according to authority.
