Mr. Son referred to Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government and found that Decree No. 15/2021/ND-CP detailing a number of contents on the management of construction investment projects; abolishing Article 12, Appendix VI, Appendix VII of Decree No. 35/2023/ND-CP amending and supplementing a number of articles of decrees under the state management of the Ministry of Construction.
In Appendix VIII of Decree No. 175/2024/ND-CP regulating the field and scope of construction activities of the certificate of construction activity capacity, there is no provision on the scope of construction activities of the certificate of construction activity capacity (the content in the corresponding scope of activities box for each class is left blank).
Thus, according to the common understanding of the content of Appendix VIII, there is no classification for the fields mentioned in sections 3.4 and 5.4. However, Articles 104 and 106 stipulate the classification for organizations.
This is the content related to the quality of organizations participating in construction activities in the energy sector, to ensure uniformity, compliance with current legal regulations, avoid making incorrect requests, especially in providing criteria for assessing the capacity of organizations in bidding for energy projects (electricity projects), Mr. Son suggested that competent authorities consider, clarify and provide guidance or consider amendments so that the electricity industry in general has a basis for implementation to ensure compliance and synchronization with other current regulations.
The Ministry of Construction responded to this issue as follows:
Based on the provisions of Point g, Clause 1, Article 56 (abolishing Clause 4, Article 148 and Clause 2, Article 159 of the 2014 Construction Law) and Clause 2, Article 58 of the 2025 Railway Law (Clause 1, Point b, Clause 3, Article 56 and Section 2, Section 3, Chapter II of this Law taking effect from July 1, 2025), from July 1, 2025, organizations participating in construction activities are not required to have a certificate of construction activity capacity.
