Besides, according to Decision No. 13/2020/QD-TTg dated April 6, 2020 of the Prime Minister on the mechanism to encourage the development of solar power; Circular No. 18/2020/TT-BCT dated July 17, 2020 of the Ministry of Industry and Trade on regulations on project development and solar power purchase and sale contracts does not stipulate that business registration procedures must be carried out when Installing and selling solar power, the process of registering and signing a power purchase agreement does not require a business registration certificate.

In Mr. Ngoan's opinion, encouraging people to install electricity on the roof (low capacity of only 5-10Kw) to both use and sell to increase household income now requires additional business registration which is not reasonable.

In addition, the regulation that units using state budget capital, worship facilities and temples that have registered to sell electricity to EVN are not subject to business registration is not fair.

Mr. Ngoan asked the authorities to provide specific instructions on the subjects that must register for the rooftop solar power business.

The Department of Planning and Investment of Ca Mau province responded to this issue as follows:

"Activities of electricity generation, transmission, distribution, wholesaling, retailing, and specialized electricity consulting" is a conditional business line (specified in Appendix IV, promulgated together with the Law) Investment in 2020);

In Clause 2, Article 79 of Decree No. 01/2021/ND-CP dated January 4, 2021 of the Government on business registration, stipulates:

"Households engaged in agriculture, forestry, fishery, salt production, and those selling street goods, snacks, trips, mobile businesses, seasonal businesses, and service workers with low incomes do not have to register for business household, except in the case of business lines with conditional business investment, the People's Committees of the provinces and centrally-run cities shall prescribe the low-income levels applicable in the locality".

Thus, organizations and individuals that have business investment in conditional business lines must make business registration. Regarding the type of business registration, you can register a business household or register an enterprise.
