If Ms. Huong's practice is revoked, will she have to start over with 12 months of practice, or will she just need to take additional CME courses in the right field and reapply for a practice license?
Regarding this issue, the Ministry of Health responded as follows:
Regarding the revocation of a medical practice license, based on Point d, Clause 1, Article 35 of the 2023 Law on Medical Examination and Treatment, the medical practice license will be revoked in the following cases: "The practitioner does not practice for 24 consecutive months, except in the case of participating in a specialized training program".
Therefore, in the case that Ms. Dang Huong Huong does not practice medical examination and treatment continuously for 24 months and does not participate in a specialized training program, the medical practice license will be revoked according to the above provisions.
Regarding the procedures after the practice license is revoked, pursuant to Clause 4, Article 33 of Decree No. 96/2023/ND-CP dated December 30, 2023 of the Government detailing a number of articles of the Law on Medical Examination and Treatment:
Within 36 months from the date of the decision to revoke the practice license, if the person whose practice license is revoked completes the practice, the procedure for reissuing the practice license shall be followed.
In case within 36 months from the date of the decision to revoke the practice license, if the person whose practice license is revoked does not complete the practice, the procedure for reissuing the practice license shall be followed.
Therefore, if Ms. Dang Huong Huong's medical practice license is revoked due to not practicing continuously for 24 months, the request for reissuance of the medical practice license will be implemented according to the provisions of Clause 4, Article 33 of Decree No. 96/2023/ND-CP mentioned above.
