Regarding this issue, the Ministry of Finance has the following comments:

According to the provisions of Clause 4, Article 78 of the Law on Bidding (amended by Law No. 57/2024/QH15 and Law No. 90/2025/QH15), the investor decides to establish a team of experts meeting the provisions of Article 19 of this Law in case he/she does not hire a consulting unit to prepare the documents of invitation for expression of interest, documents of invitation for pre-qualification, bidding documents, request documents; evaluate the documents of expression of interest, documents of pre-qualification, bidding documents, proposal documents.

According to the provisions of Clause 2, Article 134 of Decree No. 214/2025/ND-CP, in case the organization or individual assigned to conduct the appraisal is not qualified, a consulting organization with sufficient capacity and experience shall be selected for the appraisal.

Based on the above regulations, in case the investor does not have the required personnel, he/she can hire a consultant (including an organization or an individual consultant) to perform the work of the expert team or appraisal team.
