If a civil servant is not included in the annual training and development plan of the provincial People's Committee or district People's Committee, are they allowed to pursue postgraduate studies without seeking permission from the agency (or the authorized management and utilization entity for civil servants) while self-funding the studies and ensuring that the study time does not affect the work schedule of the organization and the completion of assigned tasks?

Regarding this matter, the Ministry of Home Affairs responded as follows:

The current legal regulations do not prohibit officials, civil servants, and public employees from autonomously improving their capacities and educational qualifications. In the case of Mr. Nguyen Hoang S., as a civil servant who wishes to pursue postgraduate studies and does not intend to use state budget funds or the agency's allocated budget, in addition to the right to training and development as stipulated by the Law on Officials and Civil Servants, he must also fulfill the obligations of a civil servant according to legal regulations and the internal rules and regulations of the agency or unit where he is currently employed.
