Regarding this matter, the Ministry of Health responded as follows:

Article 1 of Government Decree No. 05/2023/NĐ-CP, dated February 15, 2023, amends and supplements certain provisions of Decree No. 56/2011/NĐ-CP, dated July 4, 2011, on the regime of occupational allowances for civil servants working in public healthcare facilities. The regime of professional allowances for preventive healthcare officials and healthcare professionals at commune health stations, ward health stations, town health stations, regional polyclinics, maternity clinics, district health centers, provincial-level cities, central-level cities, district-level hospitals, and provincial-level hospitals applies from January 1, 2022, to December 31, 2023:

- The 100% professional allowance applies to regular officials directly engaged in preventive healthcare activities (including border health quarantine) and healthcare activities at commune health stations, ward health stations, town health stations, regional polyclinics, maternity clinics, district health centers, provincial-level cities, central-level cities, district-level hospitals, and provincial-level hospitals.

- During the period of application of the professional allowance for preventive healthcare officials and healthcare professionals specified in Clause 7, the provisions of Point c, Clause 2, and the provisions for regular officials directly engaged in preventive healthcare activities specified in Clause 4, Article 3 do not apply.

Based on the information provided, if Mr. Phat is working in population work at a medical station without an official position and has not been recruited as a civil servant, he is not eligible to receive the professional allowance as stipulated.
