Point b, Clause 3, Article 5 of Decree No. 175/2024/ND-CP stipulates:
"Article 5. Classification of construction investment projects
3. Construction investment projects only need to prepare a construction investment economic-technical report, including:
… b) New construction, renovation, and upgrading investment projects with a total investment of no more than VND 20 billion (excluding compensation, site clearance, and land use fees), except for cultural heritage construction investment projects implemented in accordance with the law on cultural heritage;
… d) Construction investment projects with the main content of purchasing goods, providing services, installing equipment, or repair and renovation projects that do not affect the safety of the construction with construction costs (excluding equipment costs) of less than 10% of the total investment and not exceeding VND 10 billion (except for important national projects, group A projects, and investment projects of investment under the public-private partnership method);".
Mr. Bui Quang Huy (HCMC) asked, in the case of a construction investment (renovation) project that does not affect the load-bearing structure of a work with a total investment of less than 20 billion VND, is point b, clause 3, Article 5 applicable or not, and in which cases is point d, clause 3, Article 5 applicable?
The Ministry of Construction answered this question as follows:
Cases where the project only needs to prepare an economic-technical report on construction investment are stipulated in clause 3, Article 5 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government detailing a number of articles and measures to implement the Law on Construction on the management of construction activities.
According to the content you provided, to determine whether the project is subject to the provisions of Point b or Point d, Clause 3, Article 5 of Decree No. 175/2024/ND-CP, it is also necessary to have related information such as compensation costs, site clearance, land use fees, project type (is it a cultural heritage construction investment project or not?), etc. Therefore, we suggest that you base on the above provisions and project information to determine the cases that are subject to the provisions.
