(Chinhphu.vn) - Through the receiving and responding system to enterprises’ recommendation, the TFF Co., Ltd.would like to ask competent authorities to consider reducing the obligation to register and apply for a License for retail alcohol sale on the spot to support for business households, small and medium enterprises.

The TFF Co., Ltd. is operating in the restaurant business. It is expected to sell a variety of drinks with dishes including cocktails made from alcohol and served to customers’ drinking at the restaurant.

The TFF Co., Ltd would like to ask, does the company need to apply for a liquor trading license for thecocktails sale made from alcohol for customers to drink at the restaurant? If so, what kind of alcohol or alcoholic beverage is exempted from liquor license?

In the opinion of the Company, wines quality contro is necessary and practical to protect people's health, contributing to improving food safety and hygiene. However, this should focus more on supply, production and import, instead of on-site consumption units. Because mixing, serving drinks made from alcohol is a very popular activity in many restaurants in Vietnam and most belong to business households, small and medium enterprises like the Company.

Therefore, if adding new types of licenses and procedures, it will significantly affect the Company's business operations, in the context of the restaurant has been strictly controlled in other types of procedures and regulations. .

Regarding this issue, The Ministry of Industry and Trade gives the following opinions:

According to Article 4 of the Decree No. 105/2017 / ND-CP dated September 14, 2017 of the Government stipulating wine business: “Trading in wine is on the list of sectors and trades subject to conditional business investment. Organizations and individuals that produce industrial liquors, produce liquors for the purpose of trading, distributing wine, wholesaling liquor, retailing liquors, selling liquors for consumption on the spot must have a license as prescribed in the Decree”.

According to Clause 1, Article 3 of the Decree No. 105/2017 / ND-CP: “1. Alcohol is a alcoholic beverage, produced by fermentation (with or without distillation) from starches of cereals, sugar from plants and fruits or prepared from food alcohol (Ethanol).

Alcohol does not include: all kinds; of Beer, fermented fruit juices with an alcoholic content of under 5% by volume ”.

The Ministry of Industry and Trade acknowledges the Company's recommendations on reducing the obligation to register and apply for a License for retail sale of alcohol on the spot. At the same time, it will coordinate with the related ministries to study and have the evaluation report submitted to the competent authorities for consideration and adjustment to create favorable conditions for the business activities of the enterprise.
