Regarding this issue, the Ministry of Finance has the following comments:

According to Article 70 of the 2023 Law on Bidding, when amending a contract that changes the contract implementation time or exceeds the approved bid package price (including contingency), it must be approved by a competent authority. The adjusted contract price must ensure that it does not exceed the total investment and procurement estimate. In cases where the project or procurement estimate includes multiple bid packages, the total adjusted contract price must ensure that it does not exceed the total investment and procurement estimate.

Accordingly, contract amendments comply with the above provisions. In cases where the total investment and procurement estimate have been adjusted, the contract amendments shall be based on the total investment and procurement estimate after adjustment.
