Ms. Huyen asked, does the leader of her company need to apply for a certificate of not being eligible for a work permit, or just make a report to the Department of Labor, War Invalids and Social Affairs?

In this regard, the Ministry of Labor, War Invalids and Social Affairs replied as follows:

If the company leader falls into one of the 14 cases according to Article 7 of Decree 152/2020/ND-CP dated December 30, 2020 of the Government regulating foreign workers working in Vietnam and recruiting, managing Vietnamese employees working for foreign organizations and individuals in Vietnam are not eligible for work permits for foreign workers.

It is suggested that the company to compare with actual conditions to carry out the procedures as prescribed in Decree No. 152/2020/ND-CP.
