In 2003, the warehouse of Duyen Hai Transport Ltd Company in Phu Tho Province was recognized as a customs clearance site outside the border gate and was approved for pilot application of the model of ICD domestic clearance. By April 2007, after completion of the investment in infrastructure, equipment, facilities, human resources ... meet the regulations, the Duyen Hai - Phu Tho Transport Ltd Company has been recognized the Customs clearance site at the Inland Container Depot (ICD) Thuy Van, Viet Tri (according to Decision No. 1402 / QD-BTC dated 10 April 2007 of the Ministry of Finance). This is the only place in the area to serve the needs of importers and exporters in Phu Tho and Northern mountainous provinces.

Up to now, the customs clearance site of the Duyen Hai Transport Ltd Company in Phu Tho Province is one of the imported and exported goods’ quantity that be a great clearance and stable in the number of customs clearance sites at the Inland Container Depot (ICD) Thuy Van in the Northern provinces. Conditions of equipment, infrastructure such as operator house, customs office, cargo warehouse which are awaiting a completion of import-export procedures, warehouse of infringing goods, surveillance camera system, software for import and export management to warehouses connected to customs....have always been focused by Duyen Hai Transport Ltd Company in Phu Tho Province. Each year, the Customs clearance site at the Inland Container Depot that the Duyen Hai Transport Ltd Company in Phu Tho Province carry out procedures on customs and clearance for about 170 import and export enterprises with more than 50,000 sets of declarations, equivalent to about 18,000 TEU and inspection. The actual goods at the site are about 1,000 containers (FCL), 500-700 lots of retail shipments (LCL), to create stable jobs for hundreds of employees and contribute to the state budget of tens of billions.

However, according to the new regulation of Decree No. 68/2016 / ND-CP dated July 1, 2016 of the Government, compared with the criteria of the regulations, the customs clearance site at the Inland Container Depot has not met the minimum area (Clause 4, Article 39 of Decree No. 68/2016 / ND-CP). The area of Inland Container Depot of the Duyen Hai Transport Ltd Company in Phu Tho Province reaches 21,196 m2 compared with the minimum criteria of 50,000 m2.

Duyen Hai Transport Ltd Company in Phu Tho Province needs to have a plan for the location of customs clearance at the Inland Container Depot that meets the criteria in accordance with the Decree 68/2016 / ND-CP. Regard this issue, the Company would like to report and recommend as follows:

From the beginning of the implementation of the investment project, in Document No. 1331 / UBND-TC dated July 21, 2006, the People's Committee of Phu Tho Province has agreed to grant additional land to expand the construction project of ICD Thuy Van. Based on that, the Duyen Hai Transport Ltd Company in Phu Tho Province is expanding the project according to the planning and roadmap of Phu Tho Province to meet the requirements. However, with the current land allocation, the operation of the customs clearance site at the Inland Container Depot (ICD Thuy Van) since the current accreditation still satisfy the prescribed functions and have good performance at the Inland Container Depot in accordance with the regulations of the Ministry of Transport, not be affected or restricted operation and must expand the area of land use.   

The lack of investment to expand the area is because the company does not focus on storage, but focus on speeding clearance and reduce the cost of logistics services. According to the company, this is also the policy of the Government to develop import and export. The failure to meet regulations related to the minimum area is not due to the subjective fault of the company, but also due to be suitable for the location to develop logistics, to reduce costs for industrial parks. and for import and export enterprises.

To stop the operation of the customs clearance site at the port Inland Container Depot will not only affect the convenience of customs clearance of imported and exported goods that provided by the Duyen Hai Transport Ltd Company in Phu Tho Province, but also effect the operation of a number of foreign invested enterprises that are operating in Phu Tho, Yen Bai and Tuyen Quang Provinces… Affect the livelihoods of hundreds of families who are having jobs at the Inland Container Depot (ICD Thuy Van) and thousands of employees in the logistics chain. The Duyen Hai Transport Ltd Company in Phu Tho Province said that the implementation and the meeting relevant conditions in accordance with the regulations need to have a roadmap, ensuring compliance with the situation, the ability of enterprises and the need for economic and social development in the area. Particularly, it should be considered evaluates and reasonable acknowledged the contributions made by the Customs Clearance sites at the Inland Container Depot of the Duyen Hai Transport Ltd Company in Phu Tho Province in the process of attracting investment, Socio-economic development of Phu Tho Province.

On the basis of the available advantages of the location of customs clearance at the only Inland Container Depot in the northern mountainous provinces. The company expects the Government, the Ministry of Transport, the People's Committee, other departments of Phu Tho Province, Viet Tri City and related agencies to continue to create favorable conditions on land area and reasonable location for the Customs clearance of the Inland Container Depot of the Company meets the criteria in accordance with the law, to help the company continue to promote the success of ICD Thuy Van in the coming time.

For above reasons, the Duyen Hai Transport Ltd Company in Phu Tho Province recommends the People's Committee of Phu Tho Province to allocate a suitable land for Duyen Hai Company according to the prescribed criteria of the Decree No. 68/2016 / ND-CP in order to invest in construction and extension of an Inland Container Depot,  to create conditions for the company to maintain stable operation at the places where they have been recognized as customs clearance site at the Inland Container Depot (ICD Thuy Van) which is a only one at the mountainous area of the northern provinces that do not have to terminate operation in accordance with the Resolution of the Central Conference 5 (Session 12) on the private economic development and Resolution 35/2016 / NQ-CP of the Government on support and development of enterprises up to 2020.
