- Implemented the instruction of the Ministry of Transport in the Letter No. 12572 / BGTVT-TC dated November 8, 2017 on the study and amendment of some articles of the Circular 35/2016 / TT-BGTVT dated November 15, 2016, in which, the Ministry of Transport requests: " the Directorate for Roads of Vietnam  considers the Document No. 1495/2017 / DC dated September 26, 2017 of the Deo Ca Investment Joint Stock Company in the process of rebuilding the plan of adjustment in the related contents of the Circular No. 35/2016 / TT-BGTVT to be in line with the actual situation of BOT projects in the road tunnel that be carrying out"  on the basis of reviewing and evaluating the price scheme of the Deo Ca road tunnel project (The project includes tunnels such as: The Deo Ca,  Co Ma, Cu Mong and Hai Van tunnels are the largest tunnels in Vietnam today), the Directorate for Roads of Vietnam  submitted the Ministry of Transport to report supplementing contents on submitting a draft of the Circular 35/2016 / TT-BGTVT 8421 / TCDBVN-TC dated December 29, 2017 (Details under the Annex to this document). However, when developing the draft of the Circular on amending and supplementing some articles of the Circular 35/2016 / TT-BGTVT according to the document No 844 / BGTVT-TC dated January 23, advisory bodies of the Ministry of Transport did not pay attention to the contents of the report of the Directorate for Roads of Vietnam, so it was proposed to collect opinions on the maximum tariff for the services of using road tunnel at the inappropriate level. If the proposal on the maximum tariff for the road tunnel services was proposed in the Circular amending and supplementing a number of articles of the Circular No. 35/2016 / TT-BGTVT under Document No. 844 / BGTVT-TC dated 23 January, 2008 of the Ministry of Transport approved and applied for road tunnel projects, in which, the Deo Ca tunnel project will lead to the failure to secure the financial plan, causing bankruptcy of the BOT investors in road tunnel due to unbalance of debt payment with signed credit contracts.
