Comments on the amendment and supplementation of the Decision No. 35/2015 / QD-TTg dated August 20, 2015 amending and supplementing the Decision No. 02/2012 / QD-TTG dated January 13, 2012 of the Government’s Prime Minister on the promulgation of the list of essential goods and services that must register the contract according to the form and general trading

- The Vietnam Banks Association agrees with Article 1 of the draft decree on the elimination of banking services, including the issuance of domestic debit cards, the opening and use of payment account services (applicable to personal loans (for the purpose of consumption) "from the list of essential goods and services must be registered according to forms and general trading conditions.

- In order to protect legitimate and legal interests of consumers, the Ministry of Industry and Trade may formulate mechanisms for coordination with ministries and ministerial-level agencies in performing the function of State management over the protection of consumers' interests. According to the authority of "post-check" instead of "pre-check" as the last time.

- Regarding the transitional provision: It is recommended to consider and supplement provisions related to the cases where the registration of contracts has been made according to the common forms and conditions of the transaction, and have been approved by the Ministry of Industry and Trade and the department of Industry and Trade approve for registertration, banks continue to follow the registered forms or be proactively amend, supplement or replace these forms of contracts on the basis in accordance with the provisions of law.
