From problems arising in the management of vehicles on entry and exit at border gates, the General Department of Customs is amending and supplementing a number of provisions in Decree 08/2015 / ND-CP providing specific provisions and guidance on enforcement of the customs law on customs procedures, inspection, supervision and control and Decree 59/2018 / ND-CP.

Problems on records for vehicles on entry and exit
According to the General Department of Customs, under current regulations and customs procedures, declaration for automobiles, motorcycles and inland waterway vehicles on entry and exit, the record for vehicles on entry and exit saved at the customs office only include: the declaration form of temporarily imported - re-exported vehicles or the declaration of temporarily exported - re-imported vehicles and the list of passengers (for passenger cars), therefore, the management of the customs office is not ensured.
Prevailing legal documents have not provided specific regulations on the provision of information of imported goods before they are brought into the territory of Vietnam. In many cases, the vehicles carrying imported goods pass through the border gate and regroup at the border gate or regroupment areas, inspection sites or supervision sites at border gates and then are declared, causing difficulties for handling violations in the case of banned goods and counterfeit goods.
In addition, the management of vehicles on entry and exit at the border gate creates problems in which vehicles are collateralized at credit institutions or leased from financial companies or financial leasing companies, the driver only keeps a copy of the certificate of the vehicle registration, this does not comply with the provisions on presenting the original certificate of vehicle registration upon entry and exit described in Decree 08/2015 / ND-CP and Decree 59/2018 / ND-CP. Therefore, relevant agencies such as the State Bank and tourism corporations have sent a written request to consider and amend this regulation.
In addition, in the process of carrying out customs procedures, there are also a number of problems such as: there are no specific instructions for circulation of road vehicles and entry procedures for road vehicles entering through road border gatesbut exiting through rail,sea, air ways or vice versa. For rudimentary vehicles traveling across the border and operating in the border gate area, the current regulations on inspection and supervision are also incomplete. Therefore, it is necessary to have specific regulations to ensure management.
In addition, for inland waterway vehicles on entry and exit through inland waterways, the names are not consistent with the provisions of laws such as the Law on National Border, the Law on Inland Waterway and Decree No. 112/2014 / ND-CP. Moreover, there are no specific instructions on using some forms for carrying out procedures for inland waterway vehicles on entry and exit. At the same time, there are no specific regulations to guide electronic declarations through the National Single Window portal.
Regulation on submitting copies of some documents added
In order to ensure consistency among legal documents, meeting management requirements and facilitating trade, import and export of goods, the General Department of Customs has proposed to amend and supplement a number of regulations on the management of vehicles on entry and exit at the border gate. Specifically, articles 74 and 75 will be amended in the direction of adding a regulation on submitting copies of some documents for vehicles on first entry and exit. A regulation on guiding the provision of information of imported goods before they are brought into the territory of Vietnam to meet management requirements will be added.
The draft also adds regulations for cases in which vehicles are collateralized at credit institutions or leased from financial companies, financial leasing companies, and the driver is allowed to present a copy of the certificate of vehicle registration attached with an original confirmation of the credit institution or valid contract of vehicles for lease of the finance company or the finance leasing company instead of the original certificate of vehicle registration.
A regulationfor vehicles entering through land border gates and then leaving through rail, sea, air ways or vice versa will be added. At the same time, a regulation on the inspection and supervision for rudimentary vehicles traveling across the border and operating in the border gate area to ensure management.
In addition, names of border gates and inland waterway vehicles shall be amended to be consistent with provisions of law, and there shall be specific guidance on using forms for carrying out procedures for inland waterway vehicles on entry and exit and there shall also be a regulation to guide electronic declaration and electronic procedures for inland waterway vehicles through the National Single Window portal.
