On September 3, 2026, the Ministry of Industry and Trade (MoIT) issued Circular No. 47/2026/TT-BCT detailing requirements for commodity exchange establishment dossiers, reporting obligations, and data connectivity in commodity trading activities conducted through commodity exchanges.

Connecting and sharing data with MoIT

The Circular provides detailed regulations on the information technology system description report and supporting documents demonstrating compliance with IT requirements in applications for the establishment of commodity exchanges. It also specifies the contents of an explanatory proposal on the exchange's operational model and organizational structure, as well as solutions and a roadmap for listing goods produced in Viet Nam over a five-year period.

In addition, the Circular sets out requirements on reporting, data connectivity, and the provision and sharing of information related to commodity trading activities conducted through commodity exchanges.

The regulations apply to commodity exchanges established and operating in Viet Nam, clearing centers, exchange members, providers of trading and clearing support services, and other relevant organizations and individuals.

A key provision of the Circular concerns data connectivity and information sharing with MoIT. Commodity exchanges and clearing centers must connect and transmit data through the Mercantile Exchange of Vietnam or other methods announced by the ministry.

All data must be complete, accurate, timely, and continuously updated while complying with regulations on electronic transactions, cybersecurity, personal data protection, and other relevant laws. Organizations providing data are legally responsible for its completeness, accuracy, authenticity, and timeliness.

Transaction-related information, including trading orders, transaction results, prices, and trading volumes, must be provided in real time. Information on exchange members must be updated whenever new members are added or changes occur, while commodity-related data must be submitted upon listing or whenever revisions are made.

Promoting the listing of goods produced in Viet Nam

The Circular also requires the provision of goods delivery data, including information on contracts, volumes, delivery locations, and delivery schedules.

For transaction supervision and risk management, trading alerts and signs of unusual activity must be reported in real time. Aggregated information on supervisory activities, violations, and handling measures must be submitted after trading sessions or whenever such incidents arise.

If data connectivity or information sharing is disrupted due to technical failures or force majeure events, commodity exchanges and clearing centers must promptly notify MoIT, take necessary remedial measures, and restore connectivity once systems are operational again.

For applications to establish a commodity exchange, enterprises are required to prepare an explanatory proposal outlining the organizational model and operational plan. A key component of the proposal is a roadmap and set of solutions for market development, membership expansion, and the promotion of listings of goods produced in Viet Nam during the first five years following the issuance of an establishment license.

The proposal must also include staffing plans, training programs, and operational safeguards, along with other information demonstrating feasibility, effectiveness, and compliance with legal requirements.

Regarding implementation responsibilities, commodity exchanges and clearing centers must comply with reporting obligations and data-sharing requirements, ensure the accuracy and timeliness of information submitted to MoIT, and maintain the necessary conditions for system connectivity and the storage of dossiers, data, and reports in accordance with the law.

Commodity exchanges and clearing centers that were operating before the Circular takes effect must comply with the reporting requirements and complete data connectivity and sharing within 12 months from the date MoIT announces that the Mercantile Exchange of Vietnam is ready for connection.

Circular No. 47/2026/TT-BCT will take effect on September 15, 2026, replacing Circular No. 38/2013/TT-BCT dated December 30, 2013, which set out technological solutions and technical requirements for commodity trading activities conducted through commodity exchanges.
