When must construction surveying tasks be performed again?

- Construction surveying tasks are amended and supplemented during the design process when the design contractor discovers that the construction survey report does not meet the design requirements.
Mr. Nguyen Thanh Toan (Phu Yen) asked the authorities to answer the following case: The investment project is designed in 2 steps, the feasibility study report and construction drawing design. In the step of preparing the feasibility study report, the investor has conducted a construction survey: Topographic survey (measurement of ground control network, level II pass, level III terrain; measurement of elevation control net, technical leveling, level III topography; detailed measurement of terrestrial topographical maps; 1/1.000 scale map, 1m contour line, topographic level III) to serve for the 2 steps of preparing the feasibility study report and construction drawing design (which has been checked and accepted by the investor in 2015).
However, until 2021 the design construction drawings had been carried put, a number of level I, level II crossroads have been lost (about 70%) and the previous survey time has exceeded 5 years, the design consultancy unit proposed to carry out a survey to rebuild 70% of the lost volume (including: measurement of ground control net, level II pass, level III terrain; measurement of high-level control network, technical leveling and topographical level III; measuring and drawing detailed terrestrial topographic maps; map scale 1/1.000, 1m contour line, topographic level III).
Mr. Toan asked, is such a proposal in accordance with the law? It is specified in which document?
The Ministry of Construction responded to this issue as follows:
According to the provisions of Point b, Clause 5, Article 26 of Decree No. 15/2021/ND-CP dated March 3, 2021 of the Government detailing a number of contents on management of construction investment projects, surveying tasks, etc. The construction surveyor may be amended or supplemented during the design process when the design contractor discovers that the construction survey report does not meet the design requirements.
Therefore, the design contractor needs to report to the investor for consideration and decision.
