Regarding the process of downsizing the payroll for cadres, civil servants and public employees, lawyer Nguyen Thi Hue - Hanoi Lawyers Association said: "The procedure for downsizing the payroll is clearly stated at Decree No. 108/2014/ND-CP dated November 20, 2014 of the Government and Decree 113/2018/ND-CP amending and supplementing a number of articles of Decree No. 108/2014/ND-CP on political downsizing the payroll".

 

Specifically, the downsizing process is as follows:

 

First, heads of agencies, organizations and units are responsible for coordinating with Party committees, trade unions and socio-political organizations at the same level to organize the implementation of the downsizing policy.

 

Propagating, disseminating and thoroughly grasping the policy of downsizing the payroll to cadres, civil servants, public employees and employees under their management.

 

Develop a project to streamline the staffing of their agencies or units according to the prescribed order and submit them to competent agencies for approval.

 

Make a list and estimate the subsidy amount for each subject of downsizing twice a year (every 6 months) and submit it to the competent authority for approval on the basis of the payroll reduction project which was approval by authority.

 

Second, Ministries, ministerial-level agencies, agencies attached to the Government, organizations established by the Government or the Prime Minister that are not public non-business units, People's Committees of provinces and cities directly under the Government. The Center performs the following tasks:

 

To guide agencies, organizations and units under and under organizations to implement this Decree.

 

Approving the project on downsizing the staff of agencies, organizations, and subordinate units.

 

Approving the list of subjects to reduce payrolls and using annual regular budget expenditures to pay for regimes and policies for those who are downsizing.

 

For the subjects of downsizing specified in Clause 4, Article 6 of Decree No. 108/2014/ND-CP and Clause 4, Article 1 of Decree No. 113/2018/ND-CP, the owner's representative agency shall: In accordance with the order specified in Decree No. 108/2014/ND-CP and Decree No. 113/2018/ND-CP, and at the same time request the Ministry of Finance to release the Enterprise Arrangement and Development Support Fund to settle the policy of downsizing the payroll for this subject, unless otherwise provided for by law.

 

Periodically twice a year (6 months/1 time), summarizing the results of downsizing the staff, including a list of objects of downsizing (with explanations and clarifications on the reasons for downsizing of each employee). subjects) and the budget for downsizing the payrolls of their ministries, branches and localities shall be sent to the Ministry of Home Affairs and the Ministry of Finance for inspection according to regulations.

 

Third, in addition, the Ministry of Home Affairs examines the subjects of downsizing on the basis of reports on the results of downsizing sent by ministries, branches and localities and sending comments to the Ministry of Finance as a basis. check and finalize the budget that has been streamlined in terms of staffing.

 

Fourth, on the basis of opinions of the Ministry of Home Affairs, the Ministry of Finance examines the calculation of regimes, policies, and funding for the downsizing of the staff of ministries, branches and localities to handle funding according to regulations.

 

Fifth, agencies and units directly managing cadres, civil servants and public employees pay regimes and policies for each object of downsizing.

 

Deadline for sending the list of staff downsizing for cadres, civil servants and public employees in 2022

 

Clause 12, Article 1 of Decree 113/2018/ND-CP amending and supplementing a number of articles of Decree No. 108/2014/ND-CP stipulates:

 

By July 15 every year, ministries, branches and localities shall send to the Ministry of Home Affairs and the Ministry of Finance the results of downsizing in the first six months of the year for examination according to regulations.

 

No later than January 15 of each year, the ministries, branches and localities shall send to the Ministry of Home Affairs and the Ministry of Finance the results of downsizing in the last 6 months of the preceding year for inspection according to regulations.

 

Therefore, the deadline for sending the list of staff reductions for cadres and civil servants in 2022 will be implemented as follows.

 

No later than January 15, 2022, ministries, branches and localities shall send to the Ministry of Home Affairs and the Ministry of Finance the results of downsizing in the last 6 months of 2021 for inspection according to regulations.
