In response to this issue, the Ministry of Construction replied to the voters of Binh Thuan province as follows:

On November 27, 2023, at the 6th session, the 15th National Assembly passed Law on Housing No. 27/2023/QH15 (amending the Housing Law of 2014). Accordingly: 

Subjects entitled to social housing policies

In Article 76, Clauses 2, 3, and 4, it is stipulated that the subjects entitled to support policies for social housing include:

-  Poor and near-poor households in rural areas;

-  Poor and near-poor households in rural areas located in areas frequently affected by natural disasters, climate change;

-  Poor and near-poor households in urban areas.

Article 77, Clause 1 stipulates that, based on local conditions, the Provincial People's Committee may stipulate support for the sale, lease, or rental of social housing for poor and near-poor households in rural areas, poor and near-poor households in rural areas located in areas frequently affected by natural disasters, climate change.

Conditions for enjoying social housing policies

Poor and near-poor households in rural areas; poor and near-poor households in rural areas located in areas frequently affected by natural disasters, climate change may purchase social housing if they meet the conditions for housing specified in Point a, Clause 1, Article 78 (do not own a house in the province, centrally-run cities where the social housing construction project is invested, have not purchased or leased social housing, have not enjoyed housing support policies in any form in the province, centrally-run cities where the social housing construction project is invested, or own a house in the province, centrally-run cities where the social housing construction project is invested, but the average housing area per capita is lower than the minimum housing area prescribed by the Government).

Poor and near-poor households in urban areas may purchase social housing if they meet the conditions for housing and income specified in Article 78.

Thus, Law on Housing No. 27/2023/QH15 has a national policy stipulating support for the poor to purchase social housing.

On January 8, 2024, the Prime Minister issued Decision No. 19/QD-TTg on the issuance of the List and assignment of agencies to draft detailed documents guiding the implementation of laws, resolutions passed by the National Assembly at the 6th session. Accordingly, the Ministry of Construction is assigned to lead, coordinate with relevant ministries, sectors, and localities to draft decrees on the development and management of social housing and guiding circulars.

Implementing the assigned tasks, the Ministry of Construction is leading the research and drafting of the Government's decree on the development and management of social housing, which includes specific regulations on the conditions for enjoying social housing support policies.
