(Chinhphu.vn) - Mr. Tran Dinh Truc works at Binh Duong Department of Science and Technology. Recently, the Department signed a contract for scientific research and technological development with a research organization (presiding over), in which some procurement contents are not contracted, must comply with the Bidding Law.

Mr. Truc would like to ask, can this procurement be applied with the provisions of the Circular No. 58/2016 / TT-BTC of the Ministry of Finance? The Department of Science and Technology or the host organization will organize shopping (which units are bid solicitors)?

Regarding this issue, The Ministry of Planning and Investment has the following opinions:

Clause 3, Article 4 of the Bidding Law stipulates that the bid solicitor is an agency or organization that has the expertise and capability to carry out bidding activities, including:

- Investor or organization which is decided for establishment or selected by the investor

- Estimation unit directly using capital source l

- Centralized shopping unit;

- Competent state agencies or the affiliated organizations which are selected by the competent state agencies.

For Mr. Truc's case, if the implementation of the scientific research project is not the content of the contract and the use of funds from the regular source of funding, the organization of selection of contractors shall comply with the Circular No. 58/2016 / TT-BTC.

The establishment of bid solicitors must be based on the provisions of Clause 3, Article 4 of the above Bidding Law.
