Secured transactions receive reduced registration fees

Circular No. 43/2024/TT-BTC stipulates the collection rates of a number of fees and charges to continue to remove difficulties and support production and business activities, including applying a reduction in the fee for registration of secured transactions (the collection rate is 80% of the rate prescribed in Circular No. 61/2023/TT-BTC of the Ministry of Finance).

Mr. Vu Hai Huy asked, does the above content apply to secured transaction fees issued by the Provincial People's Council according to the decentralization of the Law on Fees and Charges?

Regarding this issue, the Department of Tax, Fee and Charge Policy Management and Supervision, Ministry of Finance has the following comments:

According to the list of fees issued with the Law on Fees and Charges, the agencies regulating fees for registration of secured transactions include:

- The Ministry of Finance regulates registration activities performed by central agencies;

- Provincial People's Councils decide on registration activities performed by local agencies.

Exercising the assigned authority, based on the proposal of the Ministry of Justice, the Minister of Finance issued Circular No. 61/2023/TT-BTC dated September 28, 2023, stipulating the collection rates, collection, payment, management and use of fees in the field of registration of secured transactions.

Clause 1, Article 1 of Circular No. 43/2024/TT-BTC dated June 28, 2024 of the Minister of Finance stipulates the collection rates of a number of fees and charges to continue to remove difficulties and support production and business activities, in which the fee for registration of secured transactions is stipulated to be equal to 80% of the fee rate prescribed in Point 1 of the Table of fee rates in the field of registration of secured transactions issued together with Circular No. 61/2023/TT-BTC.

Clause 2, Article 1 of Circular No. 43/2024/TT-BTC stipulates: "2. From January 1, 2025 onwards, the collection rates of fees and charges prescribed in the above Table shall comply with the provisions of the original Circulars, Circular No. 63/2023/TT-BTC and the amended, supplemented or replaced Circulars (if any)".

Pursuant to the above provisions, the fee for registration of secured transactions issued under Circular No. 61/2023/TT-BTC and Circular No. 43/2024/TT-BTC shall be applied to secured transaction registration activities carried out by central agencies.
