If the rating is not successful, is it consistent with the law on bidding or not?

The Ministry of Planning and Investment responded to this issue as follows:

Decree No. 63/2014 / ND-CP stipulates that the evaluation of bids must be based on the bid evaluation criteria and other requirements in the bidding documents, on the basis of the bidding documents. submission, explanatory and clarifying documents to bidders to ensure the selection of qualified and experienced contractors, with feasible solutions to execute the bidding package.

Under the guidance in Section 2.2 Chapter III of the Bidding Documents Form with the application of the single-stage and two-envelope bidding procedure (Form 02) issued together with the Circular No. 03/2015 / TT-BKHDT dated May 6 / 2015 of the Ministry of Planning and Investment, the contractor must demonstrate that they have sufficient personnel for the key positions to meet the requirements of the bidding documents.
