Mrs. Pham Phuong Lan (Hanoi) asked, how does the compulsory insurance for civil liability of motor vehicle owners prioritize compensation for human damage?
Lawyer Truong Trung Nghia - Hanoi Lawyer Association answered this issue as follows:
Article 4 of Circular No. 04/2021/TT-BTC dated January 15, 2021 of the Ministry of Finance detailing a number of articles of the Government's Decree No. 03/2021/ND-CP dated January 15, 2021 on Compulsory insurance for civil liability of motor vehicle owners with instructions on compulsory insurance regime for motor vehicle owners' civil liability prioritizing compensation for human damage with the maximum level of indemnification per victim 150 million VND/person/traffic accident.
At the same time, this insurance policy does not distinguish the fault of the car owner or the driver from the fault of the victim (unless the victim is completely at fault).
Thus, the victim does not need to wait for arbitration, the degree of fault has been settled and compensated according to the actual injury rate determined after the traffic accident, reducing the time, procedures and costs for the accident. error identification. Victims do not have to collect records of hospital fees for medical treatment or wait for treatment to be completed to have these documents to make a claim.
In case the victim is completely at fault and certified by a competent authority, the compensation level will be equal to 50% of the compensation rate prescribed in this Circular.
