According to Mr. Huy's reference to Point a, Clause 1, Article 37 of Circular No. 08/2022/TT-BKHDT dated May 31, 2022, it stipulates the roadmap for selecting contractors online for the entire (100%) procurement package applying open bidding, competitive tendering in the field of goods, non-consulting services, consulting services with a tender package price not exceeding 10 billion VND and in the construction field with a tender package price not exceeding 20 billion VND.

Article 59 of Decree No. 63/2014/ND-CP dated June 26, 2014, on streamlined competitive bidding, stipulates sending direct price quotes to 3 contractors.

Mr. Huy inquired whether the implementation of streamlined competitive bidding is required to be conducted online according to the regulations in Article 37 of Circular No. 08/2022/TT-BKHDT?

On this issue, the Ministry of Planning and Investment responded as follows:

Based on Circular No. 08/2022/TT-BKHDT dated May 31, 2022, of the Minister of Planning and Investment (Clause 1, Article 1, and Clause 5, Article 4) regulating the scope of adjustments of the Circular, including the selection of contractors on the national bidding system for procurement packages of non-consulting services, goods, construction, medicine procurement within the adjusted scope of the Bidding Law, organized through open bidding, restricted bidding, domestic competitive bidding following the one-stage one-envelope, two-stage one-envelope procedures. Form No. 5 issued together with Circular No. 08/2022/TT-BKHDT is used to prepare E-Bidding Dossier for competitive bidding according to the streamlined process.

At Point a, Clause 2, Article 37 of Circular No. 08/2022/TT-BKHDT, in 2023, the selection of contractors online is applied to the entire (100%) procurement package applying open bidding, restricted bidding, domestic competitive bidding in the field of goods (including medicine), construction, non-consulting services, consulting services with a tender package price not exceeding 200 billion VND, except for mixed packages, packages applying the two-stage one-envelope procedure, and the two-stage two-envelope procedure.

Therefore, for cases of procurement packages applying streamlined competitive bidding, they fall within the scope of Circular No. 08/2022/TT-BKHDT as regulated above and are conducted online using Form No. 5 issued together with Circular No. 08/2022-TT-BKHDT.
