How to register an e-commerce website for sales?

Mr. Nguyen Kha (in Ninh Thuan Province) would like to ask: According to the recent Cyber ​​Security Law, I know that if I want to trade in goods in the form of e-commerce website, I have to register. So in order to register, which agency must I go to register and how do I pay taxes?

Regarding this issue, the Department of Industry and Trade of Ninh Thuan Province answers as follows:

Conditions for setting up sales e-commerce websites:

Pursuant to the Decree on E-Commerce: Decree No. 52/2013 / ND-CP dated May 16, 2013 of the Government on E-commerce, take effect from July 1, 2013, is amended, supplemented by the Government's Decree No. 08/2018 / ND-CP dated January 15, 2018, amending a number of Decrees related to business investment conditions under the state management scope of the Ministry of Industry and Trade, effective force from January 15, 2018.

Pursuant to the Circular on e-commerce website management: Circular No. 47/2014 / TT-BTC dated December 5, 2014 of the Ministry of Industry and Trade regulating E-commerce website management. From January 20, 2015, as amended by Circular No. 21/2018 / TT-BTC dated August 20, 2018 of the Ministry of Industry and Trade regulating E-commerce website management and Circular No. 59/2015 / TT-BTC dated December 31, 2015 of the Ministry of Industry and Trade regulating E-commerce activities via mobile applications, takes effect from October 18, 2018.

Accordingly, traders, organizations and individuals may set up sales e-commerce websites if they meet the following conditions:

- First, is the merchant, organization or individual that has been granted a personal tax code.

- Second, informed the Ministry of Industry and Trade about the establishment of sales e-commerce website as prescribed.

The process of setting up a sales e-commerce website:

The receipt and processing of notification of sales e-commerce websites are done online by the Ministry of Industry and Trade at the E-commerce Management Information Portal at www.online.gov.vn.

Traders, organizations and individuals setting up sales e-commerce websites shall access the E-commerce management portal and perform the following steps:

- Step 1: Traders, organizations and individuals register for an account to log in the system by providing the following information: Name of trader, organization or individual; Business registration number of trader or establishment decision number of organization or individual's tax code; Business areas / activities; address of the head office of the trader, organization or permanent address of the individual; contact information

- Step 2: Within 3 working days, traders, organizations and individuals receive results from the Ministry of Industry and Trade via registered email address for one of the following contents:

If the account has been fully registered, traders, organizations and individuals are granted a system login account and proceed to Step 3.

If account registration is denied or additional requests are required, traders, organizations or individuals must re-register or supplement information as required.

- Step 3: After being granted an account to log in the system, traders, organizations and individuals proceed to log in, select the function of notifying sales e-commerce website and declare information according to the form.

- Step 4: Within 3 working days, traders, organizations and individuals receive feedbacks from the Ministry of Industry and Trade via registered email addresses for one of the following contents: Information confirmation full and valid declaration; Indicates incomplete, valid, or invalid declaration information. At that time, traders, organizations and individuals must return to Step 3 to re-report or supplement information as required.

Traders, organizations and individuals are responsible for monitoring the status of application processing via email or system access account that has been granted to update and correct information as required.

Within 10 working days after receiving the notice requesting additional information in Step 4 as prescribed in Clause 2 above, if the trader, organization or individual does not respond, the notification dossier will termination and must notify the records again from Step 3.

Regarding tax obligations, Mr. Nguyen Kha is requested to contact the nearest tax authority for guidance.
