According to the guidance on the form of bidding documents for procurement issued together with Circular No. 05/2015 / TT-BKHDT, if there is an error in adding the total amount, the total amount will be corrected according to the to sum.

Mr. Ly Hai Phong (in Binh Duong Province) would like to request the authorities to guide the handling of situations in the bid evaluation process (Bid) as follows:

Bidding unit price of bidder (the number and word parts) have the same value as the value stated in the bid price summary sheet (the summary sheet only indicates numerical value, no name is required to read the name of amount in words) and the same text and numbers in the detailed quotation for the participating bidders.

But in the detailed quotation of the participating bidders, the total value is greater than the value stated in the bid application and the value recorded in the bid price summary sheet. For example:

- Bidding application for contractor recording VND 50 million.

- The summary sheet of bidder's bid, recording VND 50 million.

- The general part of the detailed price list of the goods bid for the contractor is VND 50 million. However, in the summing up the value of the detailed price list of the bidding items, the bidder is recorded at 55 VND million (if correct, this place must be VND 50 million according to the bidding application).

The expert group that has checked the quantity, unit price, amount and total amount on the detailed price list of the items submitted by the contractor in the Bidding Documents of the contractor, the total value is VND 55 million.

The expert group solves as follows:According to Clause 3, Article 17; Point b, Clause 2, Article 18 of Decree No. 63/2014 / ND-CP dated June 26, 2014 of the Government, the expert group has used the price in the bid application and the bid price summary sheet as a basis for modification; error correction and evaluation,then send send a letter to the contractor requesting the contractor to adjust in the detailed quotation for the participating bidder; The bid form is still valid.

Mr. Phong would like to ask, is the way to handle the above expert group in accordance with the Bidding Law? If not, he offered instructions on how to handle this situation.

The Ministry of Planning and Investment answers  this issue as follows:

Clause 1, Article 15 of Decree No. 63/2014 / ND-CP of the Government stipulates that the evaluation of bids must be based on the bid evaluation criteria and other requirements in the bidding documents. Based on the submitted bid, the documents explaining and clarifying the bid of the bidder to ensure the selection of a qualified and experienced contractor with feasible solutions to execute the package bid.

Under the guidance in Note (1) Clause 4.2, Section 4, Chapter III of the Form of Bidding Documents for Procurement issued together with Circular No. 05/2015 / TT-BKHDT dated June 16, 2015 of the Ministry of Planning. and Investment, if there is a mistake when adding the sumto the total amount, it will correct the total amount according to the amounts.

Regarding Mr. Phong's problem, the bid evaluation is done in accordance with the above provisions. Accordingly, the correction of arithmetic errors is done according to the detailed quotation in the bid of the contractor.
