(Chinhphu.vn) – Goods imported into inland from export processing enterprises which are subject to require import permit, these enterprises must have the import permit.

Through the receiving and responding system of businesses’ recommendations, the Samsung Electronics Vietnam Co., Ltd. would like to ask: Export processing enterprises purchase device fortransceivers from inland anddomestic enterprises that exchange goods are transceivers (mobile phones) from export processing companies, do they have to apply for import license?

Regarding this issue, The Ministry of Information and Communications responds as follows:

According to the Decree No. 164/2013 / ND-CP amending and supplementing a number of articles of the Government's Decree No. 29/2008 / ND-CP dated March 14, 2008, regulating industrial parks, export processing zones and Economic zones, Clause 9, Article 1 has stipulated:

Export processing enterprises are allowed to sell into the domestic market the liquidated assets of enterprises and goods in accordance with the law on investment and trade. Goods exchange relations are produced in export processing zones and export processing enterprises with other areas in the Vietnamese territory, except for non-tariff areas, which are import and export relations.

Point b, Clause 1, Clause 3, Article 86 and Point d, Clause 2, Article 16 of the Circular No. 38/2015 / TT-BTC dated March 25, 2015 of the Ministry of Finance has stipulated that goods imported into where an importer from an export processing enterprise is subject to an import license, the import permit is required.

Therefore, export processing and domestic enterprises, when implementing the exchange of goods and equipment must have import and export license.

In addition, the Ministry of Information and Communications issued a Circular No. 18/2014 / TT-BTTTT dated November 26, 2014 detailing the implementation of the Decree No. 187/2013 / ND-CP dated November 20, 2013 of the Government for granting licenses to import transmitter, radio transmitters and receivers. The Samsung Company has activities of exporting and importing radio transmitter device, should be based on the provisions of the Circular 18/2014 / TT-BTTTT to be granted the import license.
